Legal Assistance

The Offutt AFB Law Center provides legal services to all active duty personnel, military dependents, retirees, members of the Guard and Reserve on active duty orders.

Active Duty Members & Dependents: Legal Assistance is available by appointment only, please call (402) 294-3668 (DSN 271-3668) to schedule an appointment.

Guard and Reserve: Call (402) 294-3668 (DSN 271-3668) prior to going to the legal office to check your eligibility for legal assistance, notaries, and powers of attorney. Some services may only be available on Title 10 orders only.

Retirees & Dependents: Legal Assistance is available by appointment only, please call (402) 294-3668 (DSN 271-3668) to schedule appointments.

Article 137 Briefings are accomplished through MyLearning. Once training is complete, please send a copy of the certificate to 55WG.JAGeneralLaw@us.af.mil. 402-294-3668.

Notary & Power of Attorney Services

Limitations on Legal Assistance
Legal Assistance JAGs cannot represent you in court or in administrative proceedings. We cannot provide assistance in the following areas: Issues involving personal commercial enterprises; Law of Armed Conflict issues; Official matters in which the U.S. Air Force has an interest or is involved in the final outcome; criminal matters; or questions regarding the USAF Standards of Conduct.

Criminal Assistance
Contact the Area Defense Counsel at (402) 294-3939 or DSN 271-3939 if you have questions regarding criminal issues under the Uniform Code of Military Justice or state / federal criminal law, or questions regarding Air Force Standards of Conduct and unprofessional relationships

PCS Related Household Goods Claims
The DD Form 1840 / 1840R (pink form) must be submitted to the carrier within 70 days after delivery of a household goods shipment. This process can now be done online at https://claims.jag.af.mil. The online process only applies to Air Force sponsored moves. Members unable to file online may bring their pink forms to the claims office M, W, 9 a.m. – 3 p.m., F 9 a.m. - 1 p.m. Questions regarding the new process may be addressed to the Air Force Claims Service Center at 1-877-754-1212 (24 / 7 customer service line).

Operations Law

The Operations Law Division generally refers to legal rules applicable in actual military operations. It is normally defined as that body of domestic, foreign and international law that impacts the activities of U. S. Armed Forces in war and operations other than war. 

Commanders must ensure their personnel are trained to comply with the Law of Armed Conflict (LOAC). All military personnel must accomplish this training every 20 months.

Offutt AFB Sexual Assault Prevention & Response Office (SAPRO);
The Department of Defense does not tolerate sexual assault and has implemented a comprehensive policy that reinforces a culture of prevention, response and accountability that ensures the safety, dignity and well-being of all members of the U.S. Armed Forces.

The Sexual Assault Response Coordinator (SARC) can be reached at (402) 232-9999.

Tax Center

Effective November 17, 2023, the Offutt AFB legal office will no longer provide routine tax preparation services.

Free Local Assistance in the Omaha Area

There is free tax assistance available for the military community at the Omaha EITC Coalition. Members can schedule an appointment or do a Secure Drop to get their tax returns done by going to www.omahaeitc.org. The Coalition will open for business on January 29th and have several locations in the area. This service is by appointment only.

If anyone needs to call to set up an appointment, they can call 2-1-1 and a United Way operator will help them schedule an appointment at a site the member wants to go to.

What tax documents do I need to file?

  • Social security cards or ITINs for self, spouse, & dependents
  • Photo Identification
  • Copy of previous year’s tax returns (especially IA state return)
  • All W-2 and 1099 forms (Interest, Dividend, Miscellaneous, Retirement, SSA, Unemployment, K)
  • Gambling Winnings (W-2G, 1099-Misc)
  • Self-Employment Income and Expenses (1099-Misc, 1099-NEC, 1099-K, record of cash income and expenses)
  • Childcare provider info (Name, address, EIN/SSN) and amounts paid
  • Property tax and mortgage interest forms (1098), charitable contributions, out-of-pocket medical expenses
  • Education expenses receipts (1098-T, book receipts)
  • Marketplace Health Insurance Forms (1095A)
  • Bank account and routing number for direct deposit
  • Both spouses must be present to sign return or in case of divorce/separation, may need spouse’s name and SSN (Alimony/Filing Separate)

Military Justice Division

The Military Justice Counsel provides guidance to commanders on nonjudicial punishment proceedings and courts-martial. Call (402) 294-2358 or DSN 271-2358 for assistance.

The Area Defense Counsel (ADC) program provides independent legal representation to military members suspected of an offense or facing adverse administrative actions. Contact the ADC at (402) 294-3939 or 271-3939.

The Victims’ Counsel (VC) program provides independent legal representation to victims (both adult or children) of sexual assault, domestic violence, family violence, interpersonal violence and/or workplace violence.  Contact VC at (402) 294-8292 or DSN 271-8292 to request a VC.
